1.About these terms
These Terms of Service are an agreement between you and Mücahid Ali Karaman, a business registered in Türkiye that operates Postivate (“Postivate”, “we”, “us”), with its registered address at Meşrutiyet Mah. Karanfil Sk. Zafir İş Merkezi No: 4/91, 06420 Çankaya, Ankara, Türkiye. They apply to postivate.com, the Postivate dashboard, the Postivate API and MCP server, and everything else we offer under the Postivate name (together, the “Service”).
If you use the Service on behalf of a company or another organization, you confirm that you are allowed to accept these terms for it, and “you” includes that organization.
How we handle personal data is described in our Privacy Policy, which is part of these terms.
2.Who can use Postivate
You must be at least 18 years old and able to enter into a binding contract. Postivate is built for creators, businesses and agencies managing their professional social media presence.
3.Your account
Give accurate information when you sign up and keep it up to date. Keep your password safe and don’t share your account. You are responsible for what happens under your account, including actions taken by apps and API keys you authorize.
If you think someone else has access to your account, sign out of your other sessions from your account settings, change your password and tell us at [email protected].
4.Organizations, workspaces and team members
Your account belongs to an organization. The organization holds the subscription, the pool of channel slots and the team, and contains one or more workspaces (usually one per brand or client).
The organization’s owner decides who joins and what they can do. Owners and admins can see and manage every workspace; members and client guests see only the workspaces they are invited to, with the role they are given. The organization is responsible for the people it invites and for removing access that is no longer needed.
5.The Service
Postivate lets you write, plan, approve, publish and measure social media posts, with an AI assistant and access for AI agents and other software. We keep improving it, so features may change. If we remove something you rely on in a paid plan, we will tell you in advance where we reasonably can.
Features marked as beta or preview may be incomplete and may change or end at any time.
6.Connected social accounts
You connect social accounts (for example Instagram, X, LinkedIn, Facebook, Threads, Bluesky, Mastodon, Pinterest, TikTok and Tumblr) through each network’s own sign-in, for Mastodon on the server your account lives on, and Telegram channels and groups by adding Postivate’s bot to them as an admin. You can disconnect them at any time. Only connect accounts you are allowed to manage, and follow each network’s terms and policies when you publish through Postivate.
The networks control their own services. They can change their APIs, limits and rules, refuse or remove a post, or revoke access, and we can’t prevent that. We publish at the time you choose and retry when a network has a temporary problem, but we can’t guarantee that a network accepts, shows or keeps a post, or how it performs.
7.Your content
You keep all rights to the posts, media, Brand Profile, templates, comments and other material you or your team add to Postivate (“your content”).
You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, adapt (for example resize, convert or create previews) and transmit your content, only as needed to run the Service for you: to show it to your team, publish it where you tell us to, and send it to the services you choose to use with it. This licence ends when your content is deleted from the Service, except for copies we must keep by law.
You are responsible for your content and for having the rights to publish it. We don’t review content before it is published, but we may remove content or suspend publishing that breaks these terms or the law.
8.Acceptable use
Don’t use Postivate to:
- publish anything illegal, or anything that infringes someone else’s rights (including copyright, trademarks and privacy);
- send spam, run fake engagement, manipulate a platform, or impersonate a person or brand in a misleading way;
- harass, threaten or incite violence or hatred against anyone;
- break the terms or policies of a connected network, or get around its limits;
- upload malware, probe or attack our systems, or test their security without our written permission;
- get around plan limits, rate limits or access controls, or share accounts to avoid paying for a plan;
- copy, resell or reverse-engineer the Service, or scrape it, except as our API allows.
We may limit or suspend access when we reasonably believe these rules are being broken, and we will tell you why unless the law or a security risk prevents it.
9.AI features
The AI assistant (writing, rewriting, translation, hashtags, ideas and image generation) uses third-party AI models. AI output can be wrong, incomplete or similar to content created for others. Review it before you publish: what you publish is your responsibility.
What the AI assistant writes is saved as a draft and goes through your normal workflow. As between you and us, you own the output to the extent the law allows. Don’t use AI features to create content that breaks these terms.
AI writing is included in every plan, subject to fair-use limits that stop abuse. Image generation comes with a monthly allowance per plan (Starter 20, Pro 100, Business 500 images a month), and image packs can be added.
10.AI agents, API and webhooks
You can connect AI agents and other apps over MCP, create API keys and set up webhooks. An agent or app you connect acts as you, with your role and the permissions you grant when you connect it. API keys do what their scopes allow. You are responsible for the apps and keys you authorize; you can disconnect apps and revoke keys at any time.
Usage limits apply and depend on your plan. We may revoke a key or app that harms the Service or other customers.
11.Free trial, plans and payment
- Free trial: 7 days, no credit card. When it ends, everything you made stays readable, and publishing, scheduling, AI and adding channels, people or workspaces resume as soon as you choose a plan.
- Plans (Starter, Pro, Business) are billed monthly or yearly in advance and renew automatically at the end of each period until cancelled. Add-on packs are billed monthly.
- Prices are in US dollars and exclude taxes. Any tax that applies is added at checkout.
- Payments are processed by our payment provider, Dodo Payments. We don’t receive or store full card numbers.
- Upgrades apply immediately: the unused part of your current plan is credited and the new plan is charged from that day. Downgrades and cancellations take effect at the end of the period you have paid for.
- If a payment fails, you keep access while the payment is retried. If it can’t be collected, the organization becomes read-only until payment is made.
- We may change prices. A new price applies only from your next renewal after we have told you about it, and never to a period you have already paid for.
- Payments are non-refundable, except where the law requires a refund.
12.Cancelling and ending the agreement
You can cancel your subscription at any time; it runs until the end of the paid period. The organization’s owner can delete the organization, which deletes its workspaces, channels, posts, media and other data, as described in the Privacy Policy. Save copies of anything you want to keep first.
We may suspend or end your access if you seriously or repeatedly break these terms, if you don’t pay, or if we must for legal reasons. Where possible we will tell you first and give you a chance to fix the problem. If we end the Service for you without cause, we will refund the unused part of any prepaid period.
13.Our intellectual property
The Service, its software, design and the Postivate name and logo belong to us or our licensors. These terms don’t give you any rights to them except to use the Service as described here.
If you send us feedback or ideas, we may use them without any obligation to you.
14.Third-party services
The Service works with services we don’t control, such as social networks, AI providers, your payment method and apps you connect. Their own terms apply to your use of them, and we are not responsible for them.
Instagram, Facebook, Threads, X, LinkedIn, Bluesky, Telegram, Mastodon, Pinterest, TikTok and Tumblr are trademarks of their respective owners. Postivate is not affiliated with or endorsed by them.
15.Disclaimers
We work hard to keep Postivate reliable and secure, but we provide it “as is” and “as available”. To the extent the law allows, we don’t promise that it will be uninterrupted or error-free, or that it will achieve any particular reach, engagement or business result.
16.Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profits, revenue, data or goodwill, and our total liability for all claims relating to the Service is limited to the amount you paid us in the 12 months before the event that gave rise to the claim.
Nothing in these terms limits liability that can’t be limited by law, including liability for intent or gross negligence, or any rights you have as a consumer under mandatory law.
17.Responsibility for claims
If someone makes a claim against us because of your content or because you broke these terms or the law, you will cover the reasonable costs and damages that result, to the extent the claim is caused by you.
18.Changes to these terms
We may update these terms. If a change matters to you, we will tell you in the app or by email at least 30 days before it takes effect, unless the change is required by law sooner. If you don’t agree, you can cancel before the change takes effect; continuing to use the Service after that means you accept the new terms.
19.Governing law and disputes
These terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of İstanbul (Çağlayan) have jurisdiction over any dispute, without affecting mandatory rights you may have as a consumer to bring a claim where you live.
If any part of these terms is found invalid, the rest stays in effect. If we don’t enforce a right straight away, we don’t give it up.
